A defensive reaction against an illegitimate aggression is justified by the legal system -notwithstanding the requirement of a sufficient provocation- only if there is a rational need of the means employed to impede or repel said aggression. This requirement has created a series of complex problems regarding its interpretation and application, its conceptual extension, its true legal and practical nature, and how it is appreciated in each particular case. Precisely because of its practical relevance, the latter will be approached by this work, by the means of analyzing the Higher Courts' rulings which clearly distinguish two criteria of appreciation of the rational need.
La reacción defensiva frente a la agresión ilegítima sólo se encuentra justificada por el ordenamiento jurídico si -fuera de existir provocación suficiente- existe una necesidad racional del medio empleado para impedirla o repelerla. Dicha circunstancia ha generado intrincados problemas de interpretación y aplicación, ya en cuanto a su alcance, ya en cuanto a su naturaleza -jurídica o fáctica-, ya en cuanto a la forma de realizar su apreciación en el caso concreto. Precisamente, por su trascendencia práctica, esta última problemática es la que se abordará en el presente trabajo, analizándose -previo repaso mínimo de la doctrina nacional sobre el punto- una serie de sentencias pronunciadas por nuestros Tribunales Superiores de Justicia que distinguen claramente dos criterios de apreciación o valoración de la necesidad racional.
