  • Description: English Abstract: Benedikt Walesch analyses the provisional measures under the UPC Rules of Procedure (RoP) and compares them with preliminary injunctions in German patent litigation.He examines the requirements for provisional measures. In doing so, he discusses how the procedure can be initiated by the applicant and what costs will arise . He also discusses the jurisdiction of the UPC. In doing so, he also deals with AASI.He also examines whether, as in German law, a disposition ground and disposition claim are mandatory requirements and under what circumstances provisional measures can be issued without oral hearings. In his examination he shows that the UPC has a very broad discretionary power to issue orders.Benedikt Walesch also discusses the procedure before the UPC, the standard the UPC takes as a basis for its decisions, which orders and decisions the court can issue and how these orders and decisions can be enforced.In addition he shows the possibilities of protection for the defendant in more detail. He points out that the defendant has the possibility to take preventive protection options (protective letter) and how the defendant can defend himself if provisonal measures are only ordered after a hearing. He also highlights how the defendant can protect himself against existing insolvency risks, which legal remedies are available against final and not yet final measures, under which conditions the defendant can force the main proceedings and sheds light on possible claims for damages.In addition, Benedikt Walesch shows the possibilities of the Applicant if the UPC rules adversely on his request
