El artículo que se presenta da cuenta de los resultados de la investigación que tiene como objetivo central determinar la forma en que se han interpretado y aplicado por las autoridades competentes las diversas manifestaciones que históricamente ha tenido la autorregulación del mercado de valores en Colombia. El enfoque de la investigación que se presenta es netamente jurídico, en tanto tiene como objeto abordar el estudio de la regulación positiva en torno a la autorregulación del mercado de valores en Colombia y es de tipo descriptivo. Se tuvieron como fuentes principalmente las regulaciones normativas para lo cual fue necesario acudir a las fuentes oficiales y sobre ellas se efectuó análisis documental. El presente texto da cuenta del desarrollo de uno de los objetivos específicos propuestos, que giraba en torno a la conceptualización del fenómeno de la autorregulación en el mercado de valores. Para ello fue necesario analizar el tratamiento y regulación de los elementos que componen el concepto genérico de intermediación de valores, para posteriormente detenerse en cada una de las operaciones que la regulación ha definido de manera específica como de intermediación.
The article presented gives an account of the results of the investigation whose main objective is to determine the way in which the various manifestations that the self-regulation of the securities market in Colombia have historically been interpreted and applied by the competent authorities. The focus of the research presented is purely legal, as it aims to address the study of positive regulation around the self-regulation of the securities market in Colombia and is descriptive. The sources were mainly the normative regulations, for which it was necessary to go to official sources and documentary analysis was carried out on them. This text gives an account of the development of one of the specific objectives proposed, which revolved around the conceptualization of the phenomenon of self-regulation in the stock market. For this, it was necessary to analyze the treatment and regulation of the elements that make up the generic concept of securities intermediation, to later stop at each of the operations that the regulation has specifically defined as intermediation.
