Zusammenfassung: The Convention on biological diversity (CBD) is a global agreement addressing all aspects of biological diversity: genetic resources, species, and ecosystems. Providing for access to genetic resources and assuring the sharing of the benefits resulting from using the genetic resources is one of the aims of the CBD. This evokes the question of who is entitled to use the resources and under which conditions. Who is actually competent to decide whether an applicant is to grant access and who will actually benefit from the use of the resources? What does “fair and equitable” benefit-sharing mean? And which is the importance of the states´ sovereign rights clearly reaffirmed in the CBD? These are the questions identified and examined in this present dissertation.
