La présente contribution constitue une introduction à l’étude de la Cour constitutionnelle coréenne à travers le prisme du Conseil constitutionnel français. Elle vise à comparer les deux institutions à travers leur statut et leurs fonctions. La Cour constitutionnelle de Corée constitue un modèle intéressant de justice constitutionnelle qui, tout en étant inscrit dans un modèle d’ «emprunt » et de «transfert de technologie juridique » par rapport à des institutions juridiques étrangères, ne peut se comprendre sans son insertion dans l’histoire constitutionnelle et politique de la Corée du Sud. L’article s’attache à préciser le statut et les fonctions des deux institutions en question, à une période où les fonctions du Conseil constitutionnel français sont largement modifiées par l’introduction en droit français de la «question prioritaire de constitutionnalité » en 2008-2009.
The present paper presents an introduction to the study of the Korean constitutional court, view through the prism of the French constitutional council. It aims to compare the two institutions through their status and functions. The Korean constitutional court is an interesting model of constitutional justice standing for a model of “ loan” and “ transfert of legal technology”, in relation to foreign legal institutions. However, it cannot be understood without being included into the constitutional and political history of South Korea. The present article details the status and functions of both institutions, at a time when the functions of the French constitutional council are widely modified following the introduction into French law, in 2008-2009, of the priority preliminary rulings on the issue of constitutionality.
