Portuguese Abstract: O debate sobre a potencial conexão entre o direito da proteção de dados e o direito da concorrência tem-se intensificado, quer no contexto europeu, quer no contexto americano. As políticas de concorrência podem interferir com o pleno exercício de alguns direitos fundamentais, tais como a inviolabilidade do domicílio e da correspondência, ou o bom nome e a reputação das empresas. Vivemos numa “Sociedade de Risco”, que coabita inevitavelmente com riscos tecnológicos, genéticos, ambientais ou de segurança. Se, por um lado, a proteção de dados não pode culminar em formas mais ou menos dissimuladas de censura, por outro lado e até certo ponto, quem pretende as vantagens do universo de informação, tem que suportar também os seus inconvenientes (ubi commoda ibi incommoda)
English Abstract: The debate on the potential connection between data protection law and competition law has been intensified, both in the European context and in the American context. Competition policies can interfere with the full exercise of some fundamental rights, such as the inviolability of the home and correspondence, or the good name and reputation of companies. We live in a “Risk Society”, which inevitably cohabits with technological, genetic, environmental, or safety risks. If, on the one hand, data protection cannot be a form of censorship, on the other hand and to a certain extent, whoever wants the advantages of the information universe, must also bear some of its inconveniences (ubi commoda ibi incommoda)
