German Abstract: Private Haushalte sind vom Geltungsbereich des Arbeitsgesetzes (ArG) ausgenommen.Hausangestellte werden nicht nur durch das ArG, sondern auchdurch das OR und Normalarbeitsverträge (NAV) geschützt. Allerdings sindnur die Mindestlöhne zwingend einzuhalten. Die Arbeitszeitvorschriften derNAV können vertraglich wegbedungen werden. Es besteht somit eine Schutzlücke.Der folgende Beitrag zeigt auf, dass bei Personalverleih der Personalverleiherund nicht der Haushalt als Betrieb zu qualifizieren ist, was zur Anwendungdes Arbeitsgesetzes führt
English Abstract: Private households are excluded from the scope of the Labour Law (ArG). Domestic workers are not only protected by the ArG, but also by the CO and the standard employment contracts (NAV). However only the minimum wages are to be complied with. The working time regulations of the NAV can be excluded by contract. Therefore, there is a gap in protection. The following article shows that in the case of staff leasing, the staff leasing company and not the household has to be qualified as a business, which leads to the application of the Labour Law
