  • Beschreibung: This article discusses the role of Technology Transfer and the Clean Development Mechanism in the mitigation of climate change from a legal point of view and policy perspective. Both Technology Transfer and the Clean Development Mechanism are seemingly associated with human rights implications. Therefore, this paper will analyse the current state-of-the-art with regard to Technology Transfer and the Clean Development Mechanism in their interplay with human rights standards, and as based on relevant provisions of the Kyoto Protocol and of the EU legislation. In order to proffer solutions, this paper will assess the shortcomings of Technology Transfer and then explain the current actions that are implemented under the UNFCC to stimulate Technology Transfer and the CDM as strategies for climate change mitigation. In light of this goal, a human rights-based approach in terms of climate change mitigation strategies and its relevance will be explored
