Spanish Abstract: Este trabajo tiene por objeto abordar, desde la metodología y preceptos teóricos del Análisis Económico del Derecho, la hipótesis de la patentabilidad de programas de ordenador, con el fin de anticiparse en términos de eficiencia o ineficiencia, al resultado de proteger la propiedad intelectual de este bien inmaterial bajo el régimen de patentes, a través de la observación de las interacciones entre los sujetos y tal hipótesis, que ya es funcional en algunos regímenes jurídicos
English Abstract: This work have by object to approach from the methodology and theoretical precepts of economic analysis of law, the hypothesis of the patentability of computer programs, with the purpose to anticipate in terms of efficiency or inefficiency, the result of the protection of the intellectual property of this intangible under the patent regime, through of the observation of interactions between the subjects and such hypothesis, that is functional in some legal regimes
