  • Beschreibung: The origin of patents can be traced way back to 15th century England when Queen Elizabeth I started granting special privileges to the traders and manufactures. And the 1st case in patent law was Darcy v. Allin popularly known as ‘The Case of Monopolies,’ this case is the triggered the evolution of patents. However, In India patents originated way back when India was a British colony, by the Act VI of 1852. Patents are exclusive rights given to the inventors and the requirement of patent is that it should be novel, non obvious and capable of industrial application. In this paper I am exclusively dealing with non obviousness as the criteria of patentability
