Few institutions have undergone such profound changes as the Brazilian family. The changes affect both the institution of marriage and the relations of power and responsibility between mothers and fathers. Recent data confirms that family size has decreased as well as divorce and consensual unions have increased over time. It is necessary to highlight that changes in family laws have followed changes in real life as shown in the 1982 Constitution and the 1990 Statute of Children and Adolescents. Thus, the consolidation of new legal rights is accompanied by the increasing judicialization of social relations. In other words, the judiciary has become the arbiter of relations between parents and children, bolstering decisions in the field of human sciences. This paper presents some considerations on the implications of the judicialization of family relationships.
Poucas instituições sofreram tantas mudanças como as famílias brasileiras. Estas mudanças afetaram tanto o estatuto do casamento quanto as relações de poder e responsabilidade entre pais e mães. Dados recentes comprovam a diminuição do tamanho das famílias, bem como o aumento dos divórcios, assim como das uniões consensuais. É preciso ressaltar que a jurisprudência sobre a família tem acompanhado as mudanças da vida real, como comprovam a Constituição de 1988 e o Estatuto da Criança e do Adolescente de 1990. Dessa maneira, a consolidação de novos direitos legais é contemporânea da crescente judicialização das relações sociais. Em outras palavras, o sistema judiciário tornou-se o árbitro das relações entre pais e filhos, amparando suas decisões em disciplinas do campo das ciências humanas. O presente texto apresenta algumas reflexões sobre as consequências deste processo de judicialização no âmbito das relações familiares.
