La formación de los magistrados : del aprendizaje "en el taller"a la escuela profesional. El estudio de la transformation del modo de formation profesional de los magistrados que, al principio era esencialmente práctico y "en el taller", y se efectua desde ahora en un establecimiento específîco, permite sacar las apuestas profesionales y sociales asociadas a ese cambio del modo de reproducción de la magistratura. Hay que ver en esta empresa un proceso de reacondicionamiento de los diversos componentes del capital de la magistratura que esta destinado a luchar contra el desclasamiento objetivo del conjunto de ese grupo profesional y en el cual cada uno tiende a promover el modo de transmisión del saber que refuerza los elementos constitutivos de su propio capital. Defendida por una fracción de la magistratura, la reivindicación de una escuela, por la production y la objetivación de capital escolar que ocasiona, apa-rece entonces como un elemento esencial del proceso de afirmación de la magistratura como un cuerpo legítimo y competente.
La formation des magistrats : de l'apprentissage sur le tas à l'école professionnelle. L'étude de la transformation du mode de formation professionnelle des magistrats qui, à l'origine essentiellement pratique et "sur le tas", s'effectue désormais dans un établissement spécifique, permet de dégager les enjeux professionnels et sociaux associés à ce changement du mode de reproduction de la magistrature. Il faut voir dans cette entreprise un processus de réaménagement des diverses composantes du capital de la magistrature qui est destiné à lutter contre le déclassement objectif de l'ensemble de ce groupe professionnel et dans lequel chacun tend à promouvoir le mode de transmission du savoir qui renforce les éléments constitutifs de son propre capital. Défendue par une fraction de la magistrature, la revendication d'une école, par la production et l'objectivation de capital scolaire qu'elle entraîne, apparaît alors comme un élément essentiel du processus d'affirmation de la magistrature comme un corps légitime et compétent.
The Training of Judges : from "Learning on the Bench" to the Training College. Study of the transformation of the mode of professional training of judges, which was initially practical and acquired "on the bench" but is now done in a specific institution, makes it possible to identify the professional and social interests at stake in this change in the mode of reproduction of the judiciary. This undertaking has to be seen as a proces s of restructuring of the various components of the capital of the judiciary which is aimed at resisting the objective declassement of this occupational group and in which each individual tends to promote the mode of transmission of knowledge which strengthens the elements constituting his own capital. The demand for a training college, supported by a fraction of the judiciary, then appears, through the ensuing production and objectification of academic capital, as an essential element in the process of affirming the judiciary as a legitimate and competent body.
Die Ausbildung der Richter : Von der Ausbildung vor Ort zu einer berufsorientierten Hochschule. Die Untersuchung der Veränderung der beruflichen Ausbildung von Richtern, die ursprünglich im wesentlichen in der Praxis und "vor Ort" geschah, heute in einer spezifîschen Einrichtung vorgenommen wird, macht deutlich, was bei dieser gewandelten Reproduktion der Richter beruflich und sozial auf dem Spiel steht. Gesehen werden muß darin ein Prozeß der Reorganisation der verschiedenen Komponenten des Kapitals der Richterschaft, mit dem der objektiven Deklassierung dieser Berufsgruppe insgesamt begegnet werden soll und bei dem jede Seite versucht, die ArtderWissenvermittlung zubefördern, die die grundlegenden Elemente ihres Kapitals stärkt. Die Forderung nach einer spezifischen Ausbildungseinrichtung, die eine Fraktion der Richterschaft vertritt, erscheint so aufgrund des damit geschaffenen und objektivierten schulischen Kapitals als ein wesentliches Moment jenes Prozesses, in dem die Richterschaft sich als legitime und kompetente Körperschaft zur Geltung bringt.
