Le 15 février 438, Théodose II adresse au préfet du prétoire d’Orient Florentius un texte d’une importance capitale. Il n’est autre en effet que la disposition promulguant officiellement le recueil de lois dont il a ordonné la réalisation et qui porte son nom. Le texte, préface probable de l’ouvrage, précise notamment la date de son entrée en vigueur – ce sera le 1er janvier 439 –, indique les modalités d’application des dispositions nouvelles (les novelles) qui seront prises par la suite, rappelle les noms des membres de la commission que l’empereur avait chargé de la tâche trois ans plus tôt et invite le préfet du prétoire à diffuser l’ouvrage. Mais, et c’est le point qui retiendra ici mon attention, le texte explicite aussi l’objectif poursuivi par l’empereur : débrouiller le chaos épouvantable dans lequel se trouve alors le droit, le clarifier, mettre un terme aux incertitudes auxquelles sont confrontés les juristes et leur offrir, sous la forme d’un code, nouveau vecteur de la législation, un lumineux compendium, ainsi qu’il le dit, des lois émises depuis le règne de Constantin.
"A Bright Accomplishment How the Theodosian Code Was Drawn Up ". On February 15th 438, Theodosius II sent a most important constitution to Florentius, praetorian prefect for the Orient. Its purpose was to promulgate a set of constitutions which bore his name and whose conception he had initiated. This text, presumably the foreword of the Code, focused on the date of its implementation (due to be January 1st 439). It specified how the new constitutions (novels) were to come into effect at a later stage and also paid tribute to the members of the commission who had been entrusted with the task three years before. It eventually urged the praetorian prefect to spread the code largely. But the point this paper wants to make is to emphasize the fact that the text is also specific as to what the Emperor was aiming at, namely to straighten out the awfully chaotic state the Law was then mired in, with a view to expounding it and, by so doing, putting an end to all the uncertainties lawyers had so far grappled with, thus providing them with a new law code, a bright compendium which, as he himself put it, was to shed new light on all the constitutions promulgated since Constantine’s reign.
